Question One

In the following contractual situations, identify offer and acceptance. Provide suitable advice and support your answers with relevant cases, where appropriate.

  1. I offer to sell Jane, who is one of my students, a copy of the contract law textbook for £5.  Jane puts a note under my door three weeks later, informing me that she wants the book and attaching the £5. The day before, I sold the book to another student.

  1. Sarah writes to Bill, offering to sell him her Contract Law textbook for £6.  Bill writes back accepting, but the letter is delayed in the post and does not arrive for two weeks, by which time, Sarah has assumed that Bill does not want the book and has sold it to Jane.

  1. Would your answer be any different if Sarah and Bill had been communicating by email?

  1. Roger offers to sell his car to Ben for £1,500.  Ben replies that he is definitely interested but can only afford £1,200.  Roger does not respond to this and so Ben then leaves a message for Roger saying that he will pay £1,500.  Roger, however, has now decided not to sell the car but Ben is arguing that they have a contract.

Question Two

Nixons advertised in the local paper, a ‘special offer’ of a free toaster to anyone purchasing an item for more than £300 during the month of January.  Mark purchased a camcorder in January for £600, but had not seen the advertisement.  When he found out about the special offer, he went back to Nixons to claim the free toaster, but was refused one.  Jane bought a television in January for £350, but Nixons would not let her have a toaster as they had none left.  Subsequently, Nixons decided that it should cancel the special offer and placed a notice to this effect on its website.  Before the end of January, however, several people came into the shop expecting to get a free toaster when they spent the relevant amount, but were all refused one.

What advice would you give to each of the disappointed customers and why?
