This assignment constitutes 20% of your grade for this course. 1. Retrieve and review Florida`s Patient`s Bill of Rights and Responsibilities. A link is provided within Module 4. 2. Review the "Principles of Ethical Reasoning" outlined in Chapter 4 on pages 73-75 in the Marquis and Huston text. 3. Review the "Elements of Malpractice" discussion and Table 5.3 ("Components of Professional Negligence") in Chapter 5 on pages 96 - 98 in the Marquis and Huston text. 4. Review Display 23.5 ("Total Quality Management Principles") outlined in Chapter 23 on page 528 in the Marquis and Huston text. 5. Retrieve and read the case study entitled "The Medication, A Patient Story" which can be found at the end of these instructions and also within Module 4. Prepare a 3 to 5 page scholarly paper that addresses the following topics: 1. Describe the centralizing cause of the access to care issues in this case. Use research to support your statements, but do not repeat the case study. 2. Describe how a leader would identfy the lapses in this case, using concepts from patients` rights, ethical reasoning and professional liability. a. Which of Jill`s "Rights", as defined by Florida`s Patient`s Bill of Rights and Responsibilities, may have been violated? Why? (Limit your response in this category to the most relevant/important "rights", three to four maximum). b. How might Jill have exercised her "Responsibilities" (as defined by Florida Statute) to influence the outcome? c. Which of the ethical principles associated with the provision of healthcare were breached? By whom? Why? d. Which of the "elements of liability" may have been breached in this scenario? By whom? Why? 3. Select two (2) of the Total Quality Management Principles and describe how the leader could apply these principles to assist the healthcare professionals involved in this scenario improve outcomes and to prevent a recurrence? Be specific when describing the leader`s interventions. Support your ideas/discussion with at least three (3) peer-reviewed references. Your text can serve as one of the three. In Florida, the quality of the services that the patients get is controlled by two main concepts in the Law, which are, the Patient-Centred-Care and the Patient-And-Family-Centred-Care (Kuehn, 2012). These two concepts give the power to the patient to decide what is right for them, which is basically supported by the fact that, the medical practitioners are obligated to give disclosure of the information that the patients and their family may need to make the crucial decision affecting them. In the past and even a few cases today, some of the medical practitioners do not take time to explain to patients, the kind of care that they are eligible to. As such, in situations where the patient should have been given the opportunities to contribute and actively participate in their treatment are denied and the patient is kept in the dark about their treatment options. This is a violation of any patient as they should be given an active role in matters that concern their own health. Every other person has their own values and believes, be they religious or just personal and medical practitioners should be in a position to understand the diversity and respect the will and decisions made by their patients. All the information that patients require should also be availed to them and their families, such that when they make the decisions, they are informed choices rather than guesses. This is not to say that medical practitioners have no say in the matter, the idea is a collaborative approach to treatment, where patients should be given the upper mandate should they chose.
